1. Scope

These General Terms and Conditions apply to booking requests and contracts for stays at the Dunkelretreat, as well as to related services provided by Spiritbalance (hereinafter referred to as the “Provider”). Any terms and conditions of the guest that differ from these shall apply only if the Provider has expressly agreed to them in writing.

2. Subject Matter of the Contract

The subject matter of this agreement consists of stays in dark rooms or retreat rooms, as well as optional additional services (extras). The information presented on the website does not constitute a binding offer. By submitting the booking request, the guest makes an offer to enter into a contract.

3. Booking Request and Conclusion of the Contract

Bookings are initially made as requests. The provider reviews requests manually and confirms the booking separately (usually by email). A binding contract is not formed until the provider provides express confirmation. Online payments are not required during the booking process.

4. Prices and Services

The prices listed on the website at the time of the inquiry apply. Unless otherwise stated, prices include the applicable value-added tax. The final cleaning fee may be listed as a flat rate. Extras will only be charged if they have been requested and confirmed.

5. Terms of Payment

Payment terms (deposit, final payment, due dates) are specified in the booking confirmation or as agreed upon individually. Unless otherwise agreed, the deadlines stated in the confirmation apply.

6. Arrival, Departure, and House Rules

Arrival and departure times, as well as details regarding the retreat schedule, will be provided in the confirmation and in the preparatory information. Guests agree to follow the house rules and the organizer’s instructions to ensure the retreat proceeds safely.

7. Health Requirements

A dark retreat can be physically and mentally demanding. The guest agrees to inform the provider in a timely manner of any relevant health conditions that may affect their stay. The provider may refuse or cancel a reservation if, based on her professional judgment, a safe retreat cannot be guaranteed.

8. Cancellation and Rescheduling by the Guest

Cancellation and rebooking policies are specified in the booking confirmation or agreed upon individually. Unless otherwise noted, the following applies: Cancellations must be notified to the provider immediately in writing (e.g., by email). Any costs already incurred and lost time may be billed on a reasonable basis.

9. Withdrawal by the Provider

The provider may rescind the contract if performance is not possible for reasons beyond its control (e.g., force majeure, unforeseeable operational constraints), or if the guest breaches material contractual obligations. Payments already made for services not rendered will be refunded, unless otherwise provided by law.

10. Liability

The Provider shall have unlimited liability in cases of willful misconduct and gross negligence, as well as in cases of injury to life, body, or health. In the event of a breach of material contractual obligations due to slight negligence, liability is limited to the foreseeable damages typical for this type of contract. Otherwise, liability is excluded to the extent permitted by law. No liability is assumed for items brought by the guest or the guest’s valuables, except in cases of willful misconduct or gross negligence.

12. Final Provisions

The laws of the Federal Republic of Germany shall apply, excluding the UN Convention on Contracts for the International Sale of Goods. If the guest is a consumer, mandatory consumer protection provisions of the country of stay remain unaffected. Should any individual provisions be invalid, the validity of the remaining provisions shall remain unaffected.
